Who must appoint an energy manager in Turkey?

Short answer

An industrial operation appoints an energy manager when annual consumption is 1,000 toe or more. For commercial and service buildings the threshold is a total construction area of at least 20,000 m² or 500 toe a year. For public buildings the threshold that is applied is article 9 of the regulation, at least 10,000 m² of total construction area or 250 toe a year. Article 7 of the law still states 20,000 m² or 500 toe for commercial, service and public buildings together.

This guide explains, for Turkey, when an energy manager must be appointed and when an energy management unit must be set up. The figures come from article 7 of Energy Efficiency Law No. 5627 and from articles 9 and 25 of the regulation on increasing efficiency in the use of energy resources and energy.

Thresholds

An energy manager is the person appointed to carry out the energy-management activities defined in the regulation. Consumption is expressed in toe (tonnes of oil equivalent).

Who Threshold Basis
Industrial operation Annual total energy consumption of 1,000 toe or more Regulation article 9(1); law article 7
Commercial building and service building Total construction area of at least 20,000 m², or 500 toe a year Regulation article 9(2); law article 7
Public-sector building Total construction area of at least 10,000 m², or 250 toe a year Regulation article 9(2)
Electricity generation plant Installed capacity of 100 MW or more Regulation article 25

Article 7 of the law groups commercial, service and public buildings at 20,000 m² or 500 toe. For public buildings, the threshold applied on this site is article 9 of the regulation. The Ministry, the ENVER portal and Presidential Circular 2019/18 of 16 August 2019 also use 10,000 m² or 250 toe for the public sector.

Area and consumption

The area measure is total construction area. Courtyards, light wells, air shafts, eaves and unheated or uncooled spaces are left out. Basements, mezzanines, roof spaces and common areas are included (article 4 of the regulation). Where a campus has more than one separate building, their construction areas are added together.

Consumption uses the average of the last three years (article 9(6)). For a new building or industrial operation, if the first year’s total exceeds twice the threshold, the three-year average is not required. Tracking whether the duty applies is the management’s responsibility.

Energy management unit

Outside the public sector, industrial operations with annual total energy consumption of 50,000 toe or more set up an energy management unit (article 9(4)).

An organised industrial zone with at least 50 enterprises in operation also sets up an energy management unit, for work aimed at industrial operations below 1,000 toe and for the zone’s own energy activities (article 9(3)).

Appointment and the March notification

At an industrial operation the energy manager is a certificate holder from that operation’s own staff. Commercial, service and public buildings also look first to their own staff. If that is not possible, they may contract an energy manager or an authorised company (article 9(2)).

Those under the duty send energy consumption information, in the format set by the Ministry, by the end of March each year (article 9/A). Commercial buildings, public and service buildings, industrial operations, electricity generation plants and organised industrial zones make this notification under article 32.

Frequently asked questions

Which threshold applies to a public building?

The threshold that is applied is article 9 of the regulation. Public-sector buildings with a total construction area of at least 10,000 m², or annual energy consumption of 250 toe or more, appoint an energy manager. Article 7 of the law still groups commercial, service and public buildings at 20,000 m² or 500 toe. That sentence stays beside the regulation.

How is area measured?

The measure is total construction area. On a campus, the construction areas of the separate buildings are added together.

Which years count for consumption?

Article 9(6) uses the average of the annual totals for the last three years. For a new building or industrial operation, if the first year’s consumption exceeds twice the threshold, the three-year average is not required.

Where is the 100 MW threshold?

Appointing an energy manager at electricity generation plants of 100 MW and above is article 25 of the regulation. Article 7 of the law does not state this threshold.

When is the notification due?

Those required to appoint an energy manager or to set up an energy management unit send energy consumption information to the Ministry by the end of March each year (articles 9/A and 32 of the regulation).
